1. Introduction

These applications are called the ONEST Job Reference Applications. They are accessible via the following:

(together, the “Terms of Use Reference Apps”). The Terms of Use Reference Apps have been developed as open-source software by EkStep Foundation (“EkStep”). EkStep is a not-for-profit company incorporated under Section 8 of the Companies Act, 2013, with its registered office at No. 85, 7th Cross, Koramangala 4th Block, Bangalore 560034, Karnataka, India.

The Terms of Use Reference Apps are designed to make job opportunities more discoverable and to enable hyperlocal connections between those looking to hire and those seeking work. They enable users to post vacancies, share information about job opportunities, and manage recruitment processes. They also allow users to discover available openings, apply for jobs, and exchange related information.

The Terms of Use Reference Apps are currently being used for a pilot programme managed by EkStep to improve job matching and transparency for local hiring. During this pilot, information provided by you will be stored securely and used exclusively for operating and improving the Terms of Use Reference Apps. After the pilot concludes, the Terms of Use Reference Apps may be transitioned to a suitable organisation — such as a government body or other third party institution — to enable continued scale and impact. Your information will only be transferred to such an entity with your explicit consent, which will be separately requested at that time.

By accessing or using the Terms of Use Reference Apps, you accept and agree to be bound by these Terms of Use (“Terms”), our Privacy Policy , and any other policies or guidelines we may publish from time to time, as amended. The terms “you” and “your” refer to any person who accesses, views, or uses the Terms of Use Reference Apps. The terms “we”, “us”, and “our” refer to EkStep.

As a User, you represent and warrant that you are of legal age and are legally competent to form a binding contract (or if not, you've received your parent's or guardian's permission to use the Terms of Use Reference Apps and they have agreed to these Terms on your behalf). Minors (below eighteen years of age) may browse or view publicly available Content on the Terms of Use Reference Apps with the consent and supervision of a parent or legal guardian, but may only create or manage an account or profile with such parent’s or guardian’s active participation and consent.

If you are creating an account or using the Terms of Use Reference Apps on behalf of an Organisation, you represent and warrant that you are duly authorised to act on its behalf and to bind it to these Terms.

All users may access and browse job opportunities and related content available on the Reference Apps without creating an account. However, if you wish to post jobs or apply to job opportunities, you will need to create an account on the Terms of Use Reference Apps.

Account Creation Methods:

• Direct Web Registration: Directly through the web application — by visiting the links provided at the start of these Terms and entering the required information; or
• AI Voice Bot: Through an AI-powered voice bot — which collects the required information through a guided conversation to help you create your account or profile on the Terms of Use Reference Apps.

Please note, the AI-powered voice bot registration flow is intended only for adult users (18 years or older). Minors or persons creating profiles on behalf of minors, must complete the registration process directly through the web application, where parental or guardian consent can be properly captured and verified. We do not knowingly collect information from minors, and any such data, if inadvertently received, may be deleted in accordance with the Privacy Policy.

In both modes of registration, before an account or profile is created, you will have the opportunity to review, update, and confirm that all information shown on the Reference Apps is complete and accurate. By confirming and proceeding, you represent that the information provided (whether directly or through the bot) is true and correct to the best of your knowledge. You agree to keep such information updated at all times.

You are solely responsible for maintaining the confidentiality and security of your account credentials, and for all activities carried out through your account. You must promptly notify us of any unauthorised use or suspected breach of security.

Your access and use of the Terms of Use Reference Apps may occasionally be disrupted due to technical or operational difficulties, and such downtime may occur without prior notice. We do not guarantee uninterrupted access or availability of the Reference Apps.

Access to and use of the Terms of Use Reference Apps is subject to these Terms.

4. Privacy Policy

We take the privacy of Users seriously. Please review our full Privacy Policy , which forms part of these Terms. By using the Terms of Use Reference Apps and/or providing your information, you consent to the collection, use, and disclosure of your information in accordance with the Privacy Policy and any other applicable policies or guidelines published by us from time to time.

5. General User Responsibilities and Prohibited Uses

All Users must comply with applicable laws while using the Terms of Use Reference Apps. You agree not to misuse the Reference Apps or access them through any means other than those expressly permitted under these Terms. You are solely responsible for any content you provide and for your interactions with other Users, and you must treat all Users with respect, fairness, and in compliance with applicable law.

Prohibited Uses (Without Limitation):

• Use the Terms of Use Reference Apps for any purpose other than for the purposes set out in these Terms;
• post, upload, or distribute any defamatory, libelous, or inaccurate Content or other content on the Reference Apps;
• post, upload, or distribute any Content or other content that is unlawful or that a reasonable person could deem to be objectionable, offensive, indecent, pornographic, harassing, threatening, vulgar, hateful, racially or ethnically offensive, or otherwise inappropriate;
• post, upload, or distribute any Content (including any of the elements that such Content comprises such as text, scripts, graphics, photos, sounds, music, videos, audio-visual combinations etc.) that infringes upon any third party rights including but not limited to intellectual property rights such as copyrights or any other legal rights of individual(s)/organisation(s);
• use the Terms of Use Reference Apps in any manner that is harmful to minors, or in any manner that violates these Terms, the Privacy Policy and any other terms, guidelines and policies provided by us from time to time;
• impersonate any person or entity, falsely claim an affiliation with any person or entity, or access the accounts of others without permission, or perform any other fraudulent activity;
• delete the copyright or other proprietary rights notices on the Reference Apps or on any licensed Content;
• assert, or authorize, assist, or encourage any third party to assert, against us any intellectual property infringement claim regarding any Content you have used, submitted, or otherwise made available on or through the Terms of Use Reference Apps;
• make unsolicited offers, advertisements, proposals, or send junk mail or spam to other Users (including, but not limited to, unsolicited advertising, promotional materials, offerings or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures);
• use the Reference Apps for any illegal purpose, or in violation of any local, state, national, or international law, including, without limitation, laws governing intellectual property and other proprietary rights, and data protection and privacy;
• defame, harass, abuse, threaten or defraud Users, or collect, or attempt to collect, personal information about Users or third parties without their consent;
• remove, circumvent, disable, damage or otherwise interfere with security-related features of the Terms of Use Reference Apps;
• modify, adapt, translate or create derivative works based upon Content on the Reference Apps or any part thereof, except and only to the extent expressly permitted by the license applicable to such Content, if any;
• intentionally interfere with or damage operation of the Terms of Use Reference Apps or any User's usage of it, by any means, including without limitation by participation in any denial-of-service type attacks or by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code; or
• Deploy bots, scrapers, or automated tools (including AI-based tools) to extract, generate, or manipulate Content in a misleading, deceptive, or harmful way.

6. Additional Responsibilities of Job Providers

If you are a Job Provider, you agree to:

• ensure that all User Information you submit, including Organisation details, job listings, and supporting documents, is accurate, lawful, up to date, and not misleading;
• Refrain from posting User Information that is unlawful, fraudulent, exploitative, discriminatory, or otherwise harmful;
• ensure that all recruitment activity conducted through the Reference Apps complies with applicable laws, regulations, and guidelines, including without limitation labour, anti-discrimination, employment, and data protection laws;
• refrain from any form of discrimination based on caste, religion, race, gender, sexual orientation, disability, age, or any other status protected under Indian law;
• keep any User Information of Job Seekers received through the Terms of Use Reference Apps confidential and use it solely for legitimate recruitment purposes;
• have, maintain, and make available to Job Seekers a clear and accessible privacy policy describing how you handle their User Information, including the purposes of processing, retention periods, and rights under applicable law; and
• take appropriate technical and organisational measures to protect User Information of Job Seekers from unauthorised access, disclosure, alteration, or misuse, in compliance with applicable laws, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the Digital Personal Data Protection Act, 2023.

7. Additional Responsibilities of Job Seekers

If you are a Job Seeker, you agree to:

• ensure that all User Information you submit, including your profile, application materials, and supporting documents, is accurate, complete, and kept up to date;
• share documents or information only as necessary for job applications and related communication; and
• use the Reference Apps responsibly and in compliance with applicable laws, including those relating to data protection and privacy.

By applying to a job opportunity through the Terms of Use Reference Apps, you expressly consent to your User Information being shared with the relevant Job Provider. You acknowledge and agree that such User Information will then be handled by the Job Provider in accordance with their own privacy practices and policies, and that EkStep is not responsible for the Job Provider’s use, disclosure, or safeguarding of such information once it has been shared.

8. Content and Intellectual Property

User Content:

You are solely responsible for all Content you submit, upload, or share through the Reference Apps. By doing so, you:

• represent and warrant that you have all necessary rights, licenses, and permissions to use and share such Content; and
• grant EkStep a non-exclusive, royalty-free, worldwide, sublicensable, and transferable licence to host, store, reproduce, display, and technically format such Content solely for the purpose of operating, maintaining, and improving the Terms of Use Reference Apps.

We do not claim ownership over your Content.

Content Moderation and Takedown:

If you believe that any Content on the Reference Apps infringes your rights or violates applicable law, you may notify us at This email address is being protected from spambots. You need JavaScript enabled to view it. with sufficient details for us to evaluate and address your concern. We reserve the right to remove any Content or suspend User accounts at our discretion, particularly if the Content is unlawful, misleading, discriminatory, or otherwise in violation of these Terms.

EkStep’s Intellectual Property:

All rights in the Terms of Use Reference Apps—including their software, design, features, and branding (such as logos, names, and visual elements)—are owned by or licensed to EkStep and protected under applicable intellectual property laws. You may not copy, reproduce, modify, distribute, display, or otherwise use any EkStep content, branding, or materials without our prior written consent, unless expressly permitted by a licence. You also agree not to:

• scrape, extract, or harvest any data or Content from the Reference Apps using automated tools;
• remove or alter any copyright, trademark, or proprietary notices; or
• use EkStep’s name, logo, or branding in any manner that suggests endorsement without our permission.

Use of the Terms of Use Reference Apps does not grant you any ownership or licence in EkStep’s intellectual property, except as expressly set out in these Terms.

9. Changes to Terms

These Terms (including any policies, terms and guidelines) may be updated or modified from time to time and the revised Terms will be reflected herein. Your continued use of the Terms of Use Reference Apps constitutes acceptance of the then-current Terms. Hence, we encourage you to visit this page periodically to review any changes.

11. Indemnity

You agree to indemnify and hold harmless EkStep, along with its trustees, advisors, officers, employees, coordinators, owners, agents, information providers, affiliates, licensors, licensees, service providers, and subcontractors (collectively, the “Indemnified Parties”), from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• your breach of these Terms or any representations, warranties, or covenants made by you; or
• your use of the Terms of Use Reference Apps in a manner that causes harm to any person or violates applicable laws.

You agree to cooperate fully with the Indemnified Parties in defending any such claim. EkStep may, at its own expense, take over the exclusive defense and control of any matter subject to indemnification by you. This obligation will continue even after your account is closed or your use of the Reference Apps ends.

13. Suspension and Termination

We may suspend or terminate your registration and/or access to the Reference Apps, in whole or in part, at our discretion if you violate or breach these Terms, or while investigating any suspected or alleged violation. We also reserve the right to suspend or terminate access if required by law, regulation, or governmental request.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or proceedings arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka.

15. Electronic Agreement and Language of Terms

This document constitutes a written agreement, an electronic record, and a valid and enforceable electronic contract under the Information Technology Act, 2000 (as applicable in the Republic of India) and the rules made thereunder, as well as the amended provisions pertaining to electronic records in various statutes under applicable Indian laws. This electronic record is generated by a computer system and does not require any physical or digital signatures. Your use of the Terms of Use Reference Apps constitutes your acceptance of these Terms and any modifications or updates made to them from time to time.

For the convenience of Users, these Terms, the Privacy Policy, and other guidelines may be made available in multiple languages. In case of any inconsistency or conflict between versions, the English version will prevail and shall be the legally binding version. Translations are provided solely to improve accessibility and understanding, and while EkStep will use reasonable efforts to ensure their accuracy, it does not assume liability for any errors, omissions, or misunderstandings arising from translated versions.
